What this covers

This policy applies to the website habmate.com: the pages that present habmate and its apps, and the waitlist. The apps themselves (the web app at app.habmate.com and the apps for iPhone and Apple Watch) process further data, including health data. Separate privacy notices apply to them, which you find in the apps.

Hosting and page requests

The website runs on Cloudflare Workers, a service of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. When you open a page, Cloudflare processes technically necessary data: your IP address, date and time, the requested address, browser and operating system, and the page you came from. Cloudflare needs this data to deliver the page and to fend off attacks.

Cloudflare runs a worldwide network of data centers. Your request is usually answered by a data center near you; processing in the USA cannot be ruled out. Cloudflare is certified under the EU-US Data Privacy Framework, for which the EU Commission has found an adequate level of data protection (Art. 45 GDPR). A data processing agreement with Cloudflare is in place (Art. 28 GDPR).

The legal basis is our legitimate interest in delivering the website securely and reliably (Art. 6(1)(f) GDPR).

No cookies, no tracking

The website sets no cookies and stores nothing in your browser. It uses no analytics or advertising services and embeds no third-party content; the fonts, too, are served by habmate.com itself.

Waitlist

When you join the waitlist, including as a coach or to request a call as a brand, we process your email address, your first and last name and, if you provide it, your company or club. We also store which form you used.

The purpose is to inform you by email about your sign-up and the launch of habmate. The legal basis is your consent (Art. 6(1)(a) GDPR).

We use the double opt-in procedure: after you submit, you receive an email with a confirmation link. Only when you click it do we write to you; if you do not confirm, the link expires after 14 days. As proof of your consent, we store the time, IP address and the version of the consent text.

The data is kept in trybe, the contacts and consent platform of metacells GmbH; we send confirmation and information emails through an email service provider acting on our behalf. We store the data until you withdraw your consent.

You can withdraw your consent at any time with effect for the future, via the unsubscribe link in every email or by email to hello@metacells.com

Your rights

You have the right of access to the data we store about you (Art. 15 GDPR), to rectification (Art. 16), to erasure (Art. 17), to restriction of processing (Art. 18) and to data portability (Art. 20). You can withdraw a consent at any time (Art. 7(3)); processing up to the withdrawal remains lawful.

Where processing is based on our legitimate interest, you can object to it on grounds relating to your particular situation (Art. 21 GDPR).

Right to lodge a complaint

You can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), for example where you live or with the authority responsible for us, the Hamburg Commissioner for Data Protection and Freedom of Information.
